Privacy Policy & Terms of Use

  PART 1 — PRIVACY POLICY

1. Information We Collect

We collect personal information to provide our mentoring, consultancy, and educational resources. This includes:

Contact Data: Your name, email address, phone number, and business name when you fill out contact forms, book a session, or subscribe to our newsletter.

Financial & Transaction Data: Bank details, billing addresses, and payment histories required to process payments for retainers, memberships, or downloadable resources.

Business & Contractual Data: Information regarding your business structure, overheads, cash flow, and copies of construction contracts or subcontract agreements submitted to us for review.

Technical & Usage Data: IP addresses, browser types, and information about how you interact with our website via cookies.

2. How We Use Your Information

We use your data strictly to operate our business and deliver value to you:

To deliver one-to-one mentoring, consultancy, Business Health Checks, and contract reviews.

To process payments and fulfil orders for downloadable templates.

To manage your group membership account and community access.

To send educational content, updates, and promotional offers. You can opt out of marketing emails at any time via the ‘unsubscribe’ link.

3. Lawful Basis for Processing

Under UK GDPR, we are required to identify the legal basis on which we process your personal data. We process your data on the following grounds:

Contractual necessity — where processing is necessary to deliver the services you have engaged us for. This applies to client data collected and used in connection with quarterly consulting retainers, Business Health Checks, contract reviews, and membership accounts.

Legitimate interests — where we have a legitimate business interest in processing your data that does not override your rights. This applies to follow-up communications with enquiries, improving our services based on usage data, and marketing communications to existing clients and contacts who would reasonably expect to hear from us.

Consent — where you have actively opted in to receive communications from us. This applies to newsletter subscribers and anyone who submits their details via our website contact or booking forms. You may withdraw consent at any time by clicking the unsubscribe link in any email or by contacting us directly at [email protected].

4. Data Sharing and Third-Party Processors

We do not sell your personal data to third parties. We only share information with trusted third-party service providers necessary to run our business, including:

Payment Gateways: To securely process your transaction and subscription data.

Email Marketing & CRM Platforms: To securely store your contact info and deliver our educational updates.

Community Platforms: To host our group membership community spaces.

Legal Obligations: If required to do so by law or to protect our legal rights.

4a. International Data Transfers

Some of our third-party service providers — including our CRM platform, email marketing tools, and community hosting platforms — may store or process your data outside the United Kingdom. Where this occurs, we ensure appropriate safeguards are in place in accordance with UK GDPR, including standard contractual clauses or transfers to countries deemed adequate by the UK Information Commissioner’s Office. If you have questions about specific data transfers, please contact us at [email protected].

5. Data Retention

We retain your personal and business data only for as long as necessary to fulfil the purposes we collected it for, including satisfying any legal, accounting, or reporting requirements. For consultancy clients and contract reviews, we generally retain records for a period of 6 years following the end of our agreement to comply with UK tax and legal liability guidelines.

6. UK GDPR Compliance & Your Rights

Object to or restrict the processing of your data.

To exercise any of these rights, please contact us at [email protected].

PART 2 — TERMS OF US

1. Intellectual Property

All content hosted on our website and social media channels — including text, graphics, downloadable cashflow trackers, P&L templates, application for payment templates, and overhead calculators — is the sole property of The Construction Mentors Ltd or its licensors.

You are granted a non-transferable, single-user licence to use downloaded templates for your own internal business operations.

You may not resell, redistribute, sub-licence, or publicly share our templates, frameworks, or educational materials without our express written permission.

2. Professional Disclaimer

The mentoring, consultancy, contract reviews, and templates provided by The Construction Mentors Ltd are for educational and general advisory purposes only.

We provide business advice specifically tailored for tradespeople and construction business owners, but our services do not constitute formal legal, financial, or certified accounting advice.

Contract reviews are practical business assessments from a commercial perspective and should not replace the advice of a qualified construction solicitor. You assume full responsibility for the business decisions you make based on our resources.

2a. Cancellation and Refund Policy

Quarterly consulting retainer

The quarterly retainer is payable upfront for a three-month engagement. Once the engagement has commenced, the upfront fee is non-refundable. If you wish to cancel before the engagement begins, you must notify us in writing at least 5 working days before the agreed start date, in which case a full refund will be issued.

Monthly payment option

Where a monthly payment arrangement has been agreed, either party may terminate the arrangement with 30 days written notice. Payments already made are non-refundable. No further payments will be taken after the notice period expires.

Business Health Check

BHC sessions are non-refundable once booked. If you need to reschedule, please give us at least 48 hours notice and we will accommodate where possible. Cancellations with less than 48 hours notice will forfeit the session fee.

Tier 1 Membership

Tier 1 membership may be cancelled at any time. Cancellation takes effect at the end of the current billing month. No partial refunds are issued for unused days within a billing period.

Downloadable templates and resources

Due to the digital nature of these products, all sales of downloadable templates and resources are final and non-refundable once the download link has been accessed.

3. Limitation of Liability

To the maximum extent permitted by the laws of England and Wales, The Construction Mentors Ltd shall not be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, loss of profits, business interruption, or contractual disputes) arising out of your use or inability to use our services, advice, or downloadable templates.

4. Jurisdiction and Governing Law

These Terms of Use and Privacy Policy shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
